Terms of Service for ImgtoVideo.ai

Acceptance of Terms

By accessing or using the ImgtoVideo.ai website, mobile application, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“ToS”). If you do not agree, you must not use the Service. These ToS form a binding legal agreement between you and ImgtoVideo.ai Inc., a Delaware corporation (“ImgtoVideo.ai,” “we,” “us,” or “our”).

Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. By registering, you represent and warrant that you have full power and authority to enter into these ToS and are not barred from using the Service under applicable law.

Account Registration

To access certain features you may need to create an account. You agree to provide accurate, current, and complete information and to promptly update such information as necessary. You are responsible for safeguarding your password and for all activities that occur under your account.

User Content & License

You retain all rights to the images and text prompts you upload (“User Content”).

Prohibited Uses

You agree NOT to: (a) upload unlawful, harmful, defamatory, or sexually explicit content; (b) infringe any intellectual-property or privacy rights; (c) reverse-engineer, decompile, or attempt to extract the AI model; (d) use the Service to produce deepfakes or misleading content without clear disclosure; (e) automate mass generation that disrupts the Service; (f) resell access to the Service without written consent.

Generated Videos

Videos created by the Service (“Generated Videos”) are licensed to you under the Creative Commons Attribution 4.0 International (CC BY 4.0) license for commercial and non-commercial use, provided you comply with these ToS. You are responsible for ensuring your use of Generated Videos does not violate any laws or third-party rights.

Fees & Billing

Access to the Service is currently offered via paid plans. All fees are quoted in U.S. Dollars and are non-refundable except as required by law or at our sole discretion. We may change pricing with 30 days’ notice. Failure to pay may result in suspension or termination of your account.

Service Availability & Modifications

We strive for 99.5% monthly uptime but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation.

Intellectual Property

The Service, including its software, AI models, trademarks, and logos, is owned by ImgtoVideo.ai and protected by U.S. and international laws. Except for the limited licenses granted herein, all rights are reserved.

Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMGTOVIDEO.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID IMGTOVIDEO.AI IN THE PAST 12 MONTHS.

Indemnification

You agree to defend, indemnify, and hold harmless ImgtoVideo.ai and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, violation of these ToS, or misuse of the Service.

Termination

We may terminate or suspend your account and access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service will immediately cease, and we may delete your User Content. Sections that by their nature should survive termination shall survive.

Changes to Terms

We may update these ToS from time to time. Material changes will be posted on this page with a new effective date. Continued use of the Service after such changes constitutes acceptance of the revised ToS.
